1. Agreement to Terms

5. API Use and Third-Party AI Disclaimer

External API Integration: Our video generation tool is powered by an external API. You acknowledge and agree that Vidteex does not own, control, or have any proprietary rights to the underlying AI technology.
Third-Party Terms: Use of the API is subject to the terms and conditions imposed by the third-party provider. We make no representations or warranties regarding the performance, accuracy, or reliability of the API-powered video generation.

User-Generated Content: You retain ownership of any content you upload or submit to the Service. By doing so, you grant Vidteex a worldwide, non-exclusive, royalty-free, transferable license to use, display, and modify your content solely for the purpose of operating and improving the Service.
Generated Videos: Videos generated through the Service are provided to you under a license. You may use these videos for personal and commercial purposes; however, Vidteex retains the right to use the underlying algorithms and technology.
Third-Party Materials: Any third-party content integrated into the Service is subject to its own terms and conditions. You agree to review and comply with such terms when applicable.

8. Dispute Resolution and Governing Law

Governing Law: These Terms and your use of the Service shall be governed by and construed in accordance with the laws of Switzerland, without regard to conflict-of-law provisions.
Jurisdiction: Any legal action arising out of or relating to these Terms shall be brought exclusively in the courts located in Luzern, Switzerland
Dispute Resolution:
- Informal Negotiations: We encourage you to contact us at info@vidteex.com to resolve any disputes informally before initiating legal action.
- Binding Arbitration: If disputes cannot be resolved through informal negotiations, you agree that any unresolved claims shall be submitted to binding arbitration in accordance with the rules of an agreed-upon arbitration institution. Arbitration shall be conducted in German.
California Users and Residents: If you are a California resident, you may have additional rights under California law. Nothing in these Terms is intended to limit any rights you may have under such laws.

9. Indemnification and Limitation of Liability

You agree to indemnify, defend, and hold harmless Vidteex, its affiliates, directors, officers, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to:

Limitation of Liability
